BUI Penalties

Under Florida Statute § 327.35, a BUI conviction is generally punishable as follows:

  • First Conviction — Second-degree misdemeanor punishable by fine of up to $1,000 and/or up to six months in jail;
  • Second Conviction — Second-degree misdemeanor punishable by fine of up to $2,000 and/or up to nine months in jail;
